CMS CoPs
The Medicare Conditions of Participation (and Conditions for Coverage for suppliers) are the federal health and safety rules a provider must meet to be paid by Medicare and Medicaid.
Each provider type has its own part of 42 CFR: hospitals in Part 482 (24 conditions, each with several standards), critical access hospitals in Part 485, home health agencies in Part 484, hospices in Part 418, ambulatory surgical centers in Part 416, and so on.
Compliance is determined by survey, either by the state survey agency on behalf of CMS or by a CMS-approved accrediting organization whose accreditation carries deemed status.
The CoPs are heavy on written requirements: governing body bylaws and medical staff bylaws, patient rights notices and grievance procedures, a QAPI program with data and minutes, infection prevention and antibiotic stewardship programs, an emergency preparedness plan with policies, communication plan, and testing, nursing and pharmacy policies, medical record policies, discharge planning procedures, and contracts for outsourced services.

Who has to comply
Any provider or supplier that participates in Medicare or Medicaid: hospitals, critical access hospitals, home health agencies, hospices, skilled nursing facilities (under the separate Requirements for Participation in Part 483), ambulatory surgical centers, ESRD facilities, rural health clinics, and others.
What the assessor asks to see
Surveyors ask for the license and organizational chart, governing body and medical staff bylaws and minutes, the policy and procedure manual, patient rights notices and grievance logs, the QAPI plan and data, infection prevention and antibiotic stewardship records, the emergency preparedness plan with drills, credentialing and personnel files, medical records for tracer patients, restraint and seclusion logs, pharmacy and medication error records, contracts for contracted services, and physical environment and life safety documentation.

Who assesses CMS CoPs
State survey agencies (state health departments under agreement with CMS) and CMS regional offices conduct certification, complaint, and validation surveys.
CMS-approved accrediting organizations survey providers that choose deemed status: The Joint Commission, DNV Healthcare, the Center for Improvement in Healthcare Quality, ACHC, AAAHC, CHAP, and others depending on provider type.
Accredited by CMS approves accrediting organizations for deeming authority for a fixed term after reviewing standards and survey processes, and oversees them through validation surveys and performance reviews.
